Welcome to DogDash.

These Terms & Conditions ("Terms") govern your access to and use of the DogDash application, website and related services.

DogDash is operated by Triff Limited, a company registered in Scotland ("Triff Limited", "DogDash", "we", "us" or "our").

By creating a DogDash account or using DogDash, you agree to these Terms. Please read them carefully alongside our Privacy Policy and Community Guidelines.

If you do not agree to these Terms, you should not create an account or use DogDash.

What is DogDash?

DogDash is a location-based dog walking application that combines walk tracking with virtual territory, social and progression features.

Depending on the version of DogDash you use, features may include:

• GPS walk tracking;

• virtual patches and territory;

• claiming and defending territory;

• friends and social features;

• walk history;

• photographs and user-generated content;

• Pack Points;

• ranks;

• streaks;

• achievements or "Dashtags";

• leaderboards;

• push notifications;

• other dog walking and community features.

DogDash is intended to make dog walking more engaging. It is not a professional navigation, veterinary, emergency, security or animal-welfare service.

Who can use DogDash?

You must meet the minimum age requirement specified by DogDash to create an account.

If you are below the age at which you can legally agree to these Terms yourself in your country, you must have permission from a parent or legal guardian where permitted.

You must not create an account if you are prohibited from using DogDash under applicable law.

We may introduce or amend age restrictions where necessary to comply with legal, safety or platform requirements.

What are my responsibilities when creating an account?

You must provide information that is accurate and not deliberately misleading.

You are responsible for:

• maintaining the security of your account;

• protecting your login credentials;

• activity carried out through your account;

• keeping relevant account information reasonably up to date;

• notifying us if you believe your account has been compromised.

You must not impersonate another person, create an account using another person's information without permission, or deliberately misrepresent your identity or dog.

You should only create and operate accounts for legitimate use of DogDash.

What information can I add about my dog?

DogDash allows you to create a profile for your dog.

You are responsible for ensuring that information and photographs you provide are appropriate and that you have the right to use them.

You must not use dog profiles to:

• impersonate another user;

• harass or target another person;

• publish private information about another person;

• upload unlawful or inappropriate material;

• circumvent enforcement or account restrictions.

Some dog profile information may be visible to other DogDash users.

How does walk tracking work?

DogDash uses location information from your device to record walks and operate location-based features.

When you start a walk, DogDash may process GPS information including your route, movement, distance, timestamps and interactions with virtual patches.

Where you have granted the necessary device permissions, location tracking may continue during an active walk when DogDash is running in the background or your device is locked.

You are responsible for granting the permissions required for these features to operate.

Disabling or restricting location permissions may prevent DogDash from accurately recording a walk or providing territory features.

Is DogDash GPS always accurate?

No.

GPS, mobile devices, mapping systems and internet connections are not perfectly accurate or reliable.

DogDash does not guarantee the accuracy of:

• your location;

• walking routes;

• distance measurements;

• speed or movement information;

• patch boundaries;

• territory interactions;

• map information;

• GPS accuracy;

• timestamps;

• other location-derived statistics.

Buildings, trees, weather, device settings, battery optimisation, network availability and other environmental or technical factors may affect location accuracy.

DogDash may correct, disregard or remove activity where GPS information is clearly inaccurate, corrupted, duplicated or inconsistent with reasonable use of the service.

What are DogDash patches and territory?

DogDash divides areas of the map into virtual patches.

Users may be able to claim, hold, defend, lose or reclaim patches through qualifying DogDash activity.

DogDash territory is entirely virtual.

Owning or controlling a DogDash patch:

• does not give you ownership of real-world land;

• does not give you a right to enter private property;

• does not create a lease, licence, easement or other property right;

• does not give you priority over another person using a real-world location;

• does not give you any right to interfere with a landowner, occupier or member of the public.

You must always respect real-world property rights, access restrictions and applicable law regardless of what the DogDash map displays.

Does DogDash territory have monetary value?

No.

Unless we explicitly state otherwise, DogDash patches, territory, Pack Points, streaks, ranks, achievements, leaderboard positions and other virtual progression:

• have no cash or monetary value;

• cannot be exchanged for money;

• are not financial assets;

• do not represent ownership of DogDash or Triff Limited;

• do not create property rights;

• are not guaranteed to remain permanently available.

They exist solely as features within DogDash.

You must not attempt to sell, trade or transfer virtual DogDash territory or progression outside functionality expressly provided by DogDash.

Can territory and gameplay rules change?

Yes.

DogDash is an evolving service.

We may change, rebalance or replace gameplay mechanics where reasonably necessary to improve the service, maintain fairness, address technical issues or develop DogDash.

This may include changes to:

• patch size or boundaries;

• territory claiming rules;

• territory defence;

• protection or reservation periods;

• Pack Points;

• ranks;

• achievements;

• streak calculations;

• leaderboards;

• scoring;

• anti-cheat systems;

• eligibility requirements;

• other gameplay mechanics.

Where reasonably necessary, we may also correct, recalculate or reset gameplay information.

We will aim to avoid unnecessary disruption but cannot guarantee that virtual territory, statistics, rankings or progression will remain unchanged indefinitely.

What are the fair play rules?

DogDash is intended to reflect genuine dog walking activity.

You must not deliberately manipulate DogDash to obtain territory, rankings, achievements or other advantages unfairly.

Examples of prohibited behaviour include:

• recording journeys made primarily by car, motorcycle or other vehicle as walks;

• GPS spoofing;

• manipulating device location;

• falsifying routes or distances;

• using software or technical methods to simulate movement;

• deliberately exploiting bugs;

• automating activity intended to gain territory or progression;

• using multiple accounts to manipulate territory or rankings;

• interfering with another user's account or activity;

• attempting to bypass DogDash's anti-cheat measures.

DogDash may use automated and manual checks to identify suspicious activity.

Where we reasonably believe activity is invalid or abusive, we may:

• disregard the activity;

• remove or correct territory;

• adjust statistics;

• remove leaderboard entries;

• restrict features;

• issue warnings;

• suspend or terminate accounts.

We recognise that GPS errors can occur naturally and will aim to distinguish genuine technical issues from deliberate abuse.

Do I have to walk a dog when using DogDash?

DogDash is designed primarily around dog walking.

You are responsible for ensuring that your use of DogDash is appropriate for your circumstances and consistent with the intended purpose of the service.

DogDash does not verify the health, fitness or suitability of a particular dog for any walk.

You are responsible for deciding:

• whether your dog is fit to walk;

• how far your dog should walk;

• whether weather conditions are suitable;

• whether routes and terrain are appropriate;

• when your dog needs rest, water or veterinary attention.

If you are concerned about your dog's health or exercise requirements, seek advice from an appropriately qualified veterinary professional.

Does DogDash tell me where it is safe or legal to walk?

No.

A patch appearing on the DogDash map does not mean that you have a legal right to enter that location or that the location is safe.

You must obey:

• private property restrictions;

• access laws;

• local rules;

• road traffic rules;

• signs and barriers;

• dog-control requirements;

• livestock restrictions;

• environmental protections;

• any other applicable laws or restrictions.

Never trespass or place yourself, your dog or another person at risk to claim or defend a DogDash patch.

Real-world safety and lawful access always take priority over DogDash territory.

Should I use DogDash while crossing roads or in dangerous areas?

DogDash should not distract you from your surroundings.

Do not focus on your phone when doing so could create a safety risk.

You are responsible for remaining aware of:

• traffic;

• other pedestrians;

• cyclists;

• animals;

• terrain;

• weather;

• hazards;

• your dog's behaviour.

You should stop somewhere safe before interacting with DogDash where necessary.

How do friends work?

DogDash may allow users to send and accept friend requests.

You should only add or accept people you know and trust.

Accepted friends may be able to see additional information about your DogDash activity, which may include walk-related information, photographs, social activity or other information made available through friend features.

You are responsible for deciding who you add as a friend.

Do not use friend or social features to harass, monitor, intimidate or improperly track another person.

You can remove friends using the functionality provided by DogDash where available.

What are the rules for user-generated content?

DogDash may allow you to upload or share content such as:

• profile photographs;

• dog photographs;

• walk photographs;

• profile information;

• other content introduced through social features.

You retain ownership of content you own.

However, by uploading content to DogDash, you give Triff Limited a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and process that content as reasonably necessary to operate, provide and improve DogDash.

This licence exists only to allow us to provide the service and does not transfer ownership of your content to us.

You must have the necessary rights and permissions to upload content.

What content is prohibited?

You must not upload, publish or use DogDash to distribute content that:

• is unlawful;

• is threatening or seriously abusive;

• harasses another person;

• promotes hatred or discrimination;

• depicts or encourages animal cruelty;

• contains sexual or pornographic material inappropriate for the service;

• infringes intellectual property rights;

• exposes another person's private information without permission;

• impersonates another person;

• promotes dangerous or illegal behaviour;

• contains malicious software or harmful code;

• is otherwise prohibited by our Community Guidelines.

We may remove content that we reasonably believe breaches these Terms, our Community Guidelines or applicable law.

Can DogDash moderate content and accounts?

Yes.

We may investigate reports or activity that may breach these Terms or our Community Guidelines.

Depending on the circumstances, we may:

• remove content;

• restrict visibility;

• correct gameplay data;

• remove territory or progression;

• issue a warning;

• restrict particular features;

• temporarily suspend an account;

• permanently terminate an account;

• preserve relevant information where reasonably necessary for security, disputes or legal obligations.

We are not required to apply the same action in every case. Enforcement may depend on factors such as severity, repetition, intent, risk and available evidence.

Where appropriate, users may be able to contact us regarding an enforcement decision.

Can I report another user?

Yes.

Where reporting functionality is available, you can report users or content that you reasonably believe breaches DogDash rules.

You should use reporting functionality honestly and responsibly.

Deliberately submitting false, malicious or abusive reports may itself constitute misuse of DogDash.

For urgent real-world safety matters or suspected criminal behaviour, contact the appropriate emergency service or authority rather than relying on DogDash reporting tools.

How do achievements, ranks and leaderboards work?

DogDash may award virtual achievements, Pack Points, ranks, streaks or leaderboard positions based on qualifying activity.

These features are intended for entertainment and engagement.

We may adjust calculations or remove activity where:

• data is inaccurate;

• a technical error occurs;

• activity breaches fair-play rules;

• an exploit has affected results;

• gameplay mechanics are changed or rebalanced.

Leaderboard position and other rankings are not guaranteed.

How do push notifications work?

If you allow notifications, DogDash may send you messages relating to your activity or account.

These may include:

• walk reminders;

• streak reminders;

• territory alerts;

• friend activity;

• achievements;

• progression milestones;

• service or account information.

Notification delivery is not guaranteed and may depend on your device, operating system, internet connection, notification settings and third-party notification services.

You can control notification permissions through your device settings.

Is DogDash currently an Early Access service?

DogDash may initially be made available as an Early Access or developing service.

During this period:

• features may change;

• errors may occur;

• functionality may be added or removed;

• data or progression may occasionally require correction;

• service availability may vary;

• performance may not reflect the final version of DogDash.

By using an Early Access version, you acknowledge that the service is still developing.

We welcome feedback but are not obliged to implement suggestions or maintain any particular feature.

Will DogDash always be free?

DogDash may currently offer some or all functionality without charge.

In the future we may introduce:

• optional subscriptions;

• premium features;

• advertising;

• in-app purchases;

• commercial partnerships;

• discounts;

• other paid services.

We will not charge you for a new paid service without clearly informing you of the applicable price and obtaining any agreement or authorisation required.

Additional terms may apply to future paid functionality.

What about discounts, offers or third-party businesses?

DogDash may in future display offers, discounts, venues, products or services provided by third parties.

Unless explicitly stated otherwise:

• DogDash does not provide the third-party product or service;

• availability and terms are controlled by the relevant provider;

• offers may change or expire;

• DogDash does not guarantee the quality or suitability of third-party goods or services.

Any transaction with a third party is subject to that provider's terms.

Nothing in these Terms limits rights you may have under applicable consumer law.

Does DogDash use third-party services?

Yes.

DogDash relies on third-party technology and infrastructure providers for aspects of the service, including hosting, app functionality, mapping, notifications and other technical services.

We cannot guarantee that third-party systems will always operate without interruption.

Is DogDash always available?

No online service can guarantee uninterrupted availability.

DogDash may occasionally be unavailable because of:

• maintenance;

• upgrades;

• technical faults;

• internet or hosting failures;

• third-party service outages;

• security incidents;

• circumstances outside our reasonable control.

We may temporarily suspend all or part of DogDash where reasonably necessary.

We will aim to restore service as soon as reasonably practicable.

Can DogDash features be removed or discontinued?

Yes.

We may add, modify, suspend or discontinue features where reasonably necessary.

If DogDash or a significant part of it is discontinued, we will take reasonable steps to provide appropriate notice where practicable.

You do not acquire a permanent right to any particular free feature, virtual territory, achievement, ranking or gameplay mechanic merely because it was previously available.

Who owns DogDash?

DogDash and its underlying intellectual property are owned by or licensed to Triff Limited.

This includes, where applicable:

• the DogDash name and branding;

• logos and visual identity;

• software;

• interface designs;

• graphics;

• text;

• original gameplay systems and presentation;

• databases and other protected materials.

These Terms give you a limited, personal, non-exclusive, non-transferable and revocable right to use DogDash for its intended purpose.

They do not transfer ownership of DogDash intellectual property to you.

You must not copy, modify, reverse engineer, distribute, sell or commercially exploit DogDash except where expressly permitted by law or by us.

Can I delete my account?

Yes.

DogDash provides an account deletion process.

Deleting the app from your device does not automatically delete your DogDash account.

Where you request account deletion, we will handle associated personal information as described in our Privacy Policy and Data Deletion information.

Certain information may need to be retained or anonymised for legitimate legal, security, fraud-prevention or operational reasons.

Can DogDash suspend or terminate my account?

Yes.

We may restrict, suspend or terminate an account where we reasonably believe:

• these Terms have been seriously or repeatedly breached;

• our Community Guidelines have been breached;

• cheating or manipulation has occurred;

• the account poses a security risk;

• the account is being used unlawfully;

• the user is not eligible to use DogDash;

• suspension or termination is reasonably necessary to protect DogDash, our users or third parties.

Where appropriate and reasonably practicable, we may provide a warning before taking serious enforcement action.

Serious abuse, security threats or unlawful activity may result in immediate action.

What happens to virtual territory if my account is deleted or terminated?

If your account is deleted or terminated, virtual territory, Pack Points, streaks, ranks, achievements, leaderboard positions and other account-related progression may be removed, released, anonymised or otherwise adjusted.

You are not entitled to compensation for loss of virtual territory or free virtual progression following account deletion, legitimate enforcement action, gameplay rebalancing or discontinuation of the service.

This does not affect any statutory rights you may have in relation to paid products or services introduced in the future.

What is DogDash responsible for?

We are responsible for providing DogDash with reasonable care and skill and for complying with obligations that apply to us under law.

However, DogDash is provided as a recreational dog-walking and location-based service.

To the fullest extent permitted by law, we do not guarantee that:

• DogDash will always be available;

• GPS information will always be accurate;

• maps will always be complete or current;

• territory calculations will always be error-free;

• another user will behave appropriately;

• virtual territory will remain under your control;

• every notification will be delivered;

• the service will be completely free from bugs or interruptions.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

Are you responsible for my real-world walking decisions?

You remain responsible for your own decisions and conduct while using DogDash.

DogDash does not instruct you to enter a particular physical location merely because a patch appears on the map.

You must use your own judgement regarding:

• route safety;

• lawful access;

• traffic;

• weather;

• terrain;

• your health;

• your dog's health and welfare;

• interactions with other people or animals.

Never take an unnecessary risk simply to claim or defend virtual territory.

What if another user causes me a problem?

Users are responsible for their own conduct.

DogDash may provide reporting and moderation functionality, but we cannot guarantee or control the behaviour of every user.

If another user behaves inappropriately within DogDash, you should use the available reporting tools or contact us.

If you believe there is an immediate threat to a person or animal, contact the appropriate emergency service or authority.

Can these Terms change?

Yes.

We may update these Terms to reflect:

• new features;

• changes to DogDash;

• legal or regulatory requirements;

• security requirements;

• changes to commercial arrangements;

• changes to how the service operates.

Where a change is material, we will take reasonable steps to notify users where appropriate.

The date at the top of these Terms shows when they were last updated.

Continuing to use DogDash after updated Terms take effect may constitute acceptance of those Terms where permitted by law.

Where applicable law requires a different form of consent, we will follow that requirement.

What law applies to these Terms?

These Terms are governed by the laws of Scotland, subject to any mandatory consumer protections that apply to you.

If you are a consumer living elsewhere in the United Kingdom or another jurisdiction, you may also benefit from mandatory rights available under the laws applicable to you.

Nothing in these Terms is intended to remove rights that cannot lawfully be excluded.

What if part of these Terms is unenforceable?

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Our failure to enforce a provision immediately does not mean we permanently waive our right to enforce it.

Do these Terms create a partnership or employment relationship?

No.

Your use of DogDash does not create an employment, agency, partnership, joint venture or franchise relationship between you and Triff Limited.

Virtual DogDash progression or participation does not give you any ownership interest in Triff Limited or DogDash.
